I believe another aspect of the case was that there was something wrong with the crosswalk lights, and that this had been reported to the municipality a number of times in the months prior to the accident, and they hadn't fixed them.
Also, I think there were witnesses who said that they had seen the truck driver driving aggressively just prior to the accident.
