I'm another non-US person, but isnt it an option to start seeing a new pdoc without having your old records first, like Penny seems to have done?
Of course, you should still get to see the old ones, and I hope someone legal can help you get them out of him, but it would be a shame for you to be delaying getting started with a better pdoc because of this records carry-on.
If he's a member of some sort of professional organisation, you could also try complaining about him to them, if you want to. He sounds hopeless- hope you get a better one soon.
