In the case of olanzapine, the original patent expired in 1995, before the drug was approved as an antipsychotic. Lilly had obtained a new patent, though, and the issue was taken to court by a hopeful generic manufacturer. Lilly won, as their new patent was for the previously unknown antipsychotic activity, which had the property been appreciated by them (or others), it would have been marketed by them. Thus, the antipsychotic activity was upheld as a novel and patentable character of the drug, despite the expiry of the original patent. Lilly's newer patent does not expire until April 2011.
