Is a car an asset collections agency can take?

Mine is paid for. I also have about $5,000 in a 401K. Can a collections agency take any of that when the hospital and ambulance company turns my account over? What else can the hospital and ambulance company do to screw me, besides ruining my credit score?

In general, a collections agency can't take anything but your voluntary payment for a debt. And there are federal laws about how little they are allowed to harass you.

The creditor (hospital) can file a civil suit against you and obtain judgment against you in the amount you owe (sometimes less). Not sure if a collections agency can do this or not. In the case of a civil judgment against you, some states allow the creditor to go after personal or real (land) property.

Generally, it's in the hospital's best interest to set up a payment plan with you, and I believe even if you pay as little as $10 a month, that shows a good faith effort on your part to repay the debt. I'd have to check into that some more.

From what I know they can't touch either of those. They can call you constantly and drive you nuts. I think your car and 401K are safe as would be a home. At the very least go to someplace like Consumer's Credit and get them to negotiate for you.

You know here you were suicidal so your're not in the best mental frame. Too bad you can't sue them for releasing you to unsafe conditions if they had you walk home in the middle of the night. Every hospital I ever worked at had to provide a taxi. Love Phillipa ps and the $l0 a month is right I think. I did malpractice as an Rn and unfortunatly for it to be a case it must cause permanent and lasting damage. Like an amputation to leg where a cast was too tight and no one took it off.

i have bad credit due to fraud and they cannot touch money in the bank or any of my vehicles. just don't piss the IRS off ;~{

No - they can't take your shelter, or anything that you need to make a living.
