Hi...
My short-term disabilty is about to expire, and I just got a call from my long-term carrier. They said that because I have a pre-existing illness, my benefits are denied! I cannot afford my current doctor without a paycheck. Has anyone been in a similar situation? Is there anything I can do???
Being shit on,
Jon :(

Hi Jon,This is my current condition,
My short term carrier (my company) carriers me for 1 month. My long term carrier (an insurance underwriter) agrees to carry me for upto 6 months after that pending an analysis of my case. They reviewed my doctor's notes and were "glad"
to inform me that they approved long-term coverage and believed that I ought to be able to return to work on a date that was "2 days" after the date that my short term carrier's coverage let up! What bullshit. (I'm still fighting this).I see your dilemma. I have the fortunate that my doctor charges 300 dollars an hour to patients with insurance and 70 dollars an hour to patients withouu coverage. But I am still out my paycheck which is a shit load of money compared to my doctors bill.
So what to do? I think by default the insurance company will push back on any claim.
This is my first time on medical disability for mental health leave, is it for you?
Sorry.
John

An in-law is a lawyer who has worked on both sides of the disability fence for disability claim. I may be able to use her as a resource.John

Are they saying you were able to work while having the illness? (thus the denial).Or do they only allow a disability claim on the illness for a certain amount of time? (.i.e you claimed it before and can't do it again??)
What does your psychiatrist say? My psychiatrist helped handled a lot of the paperwork and BS from the insurance company with me (since he would get payed more I guess).
Thanks for the answers, I may run into this myself.

I couldn"t resist reading a thread on disability! So, are you saying that you have not been able to collect any $ from your LONG TERM carrier after the two day period after your short term carrier stopped paying? EEEEK.

I know this doesn't belong here (in PB), but shhhh ... just this once!
What is/was your job? I know you told me before, but my memory is shot, and I forget. Sorry.
Also, in a thread further I had a couple of computer questions for you, one of which I figured out (how were you able to provide a URL for your earlier thread about your BP/BPII symptoms - I spotted where the URL's appear on the computer screen).
BUT - how did you remember the URL for a post you did a long time ago - did you jot it down at the time so you could refer to it? Just curious. Thanks!

The long term carrier should pay. They just need more documentation from my pdoc that my leave need to be extended. I fortunately have enough of a financial cushion to wait this out in the mean while.John

They haven't said anything official yet, but they interviewed me on the phone and said that if my condition is pre-existing I will be denied benefits. They defined pre-existing as receiving any meds or treatment up to 3 months before starting my job. Well, obviously I have a pre-existing condition and I expect to be denied. My psychiatrist says there is absolutely no reason why I should be denied and was pissed. However, the law is the law and if having a pre-existing condition denies me... She said that I should apply for social security deisability because I should definitely get that, but I'll likely have to appeal that decision as well. Is it wise to hire a lawyer when appealing these decisions? Like I have the money to do that...
All smiles,

I replied:
I have experience with the SSDI issues. You *CANNOT* hire an attorney for your SSDI claim, _Until_ You have been denied, then appealed, then had your Appeal Denied. I am not certain if this is a state mandate <I live in Washington State> or a Federal one. But the good news is, once you are able to get an attorney, they are limited on what they can charge. The judge in the case *Assigns* their fees and the amount they can take from your back payments *If* you win.A note here, the amount you will get *If* you win, will be the monthly alotment, less the first 6 months from the date you originally filed. And they usually only get about 25% of the total amount.
Hope this helps.
Blessings,
