Legal aspects of Psychiatric Nursing

Posted by Wayne Belcher on October 22, 1999, at 17:51:30

I am a nursing student currently doing a clinical rotation at a state mental hospital. I have searched far and wide for information on the legal aspects of Psychiatric Nursing. Any assistance in locating information on this subject will be greatly appreciated. Many thanks in advance. Wayne

Wayne,

Umm. The legal aspects of psychiatric nursing would be the same as the legal aspects of any other profession.

The legal aspects of specific actions that psychiatric nurses might take are a different question entirely.

If you have any particular actions in mind, it would be interesting to hear what they are; however, be very wary of legal advice or information presented over the internet, especially since nobody who you'll probably end up talking to (myself explicitly included) has any authority or legal right to dish out said legal advice.

Good luuuuuck!

Wayne -
I'm very interested in your question. I am a graduate student in nursing at the university of massachusetts and for my final semester I will be developing models for teaching legal aspects to nursing students and nurses. I have practiced health law for 15 years and that helped shape my interest in developing a model. It's been my impression that nurses want information but lack resources. The ones I've come across tend to frighten and obfuscate issues. I am very interested in finding out more about what you want to know. Would you be willing to send me an email with your thoughts - what are the situations which trigger your concerns, what resources do you see in your setting, any other thoughts you might have. I look forward to hearing from you (and any other nurse or nursing student who might provide input. Thanks a lot.
Anita

A good basic reference is law in the Health and Human Services by Donald T. Dickson (The Free Press, 1995). It's possible there is a more recent edition.

Also, sometimes professional organizations publish position papers, brochures, etc. for members on different aspects of professional practice. Is there a national nursing association?
